Unresponsive builder who does not honor home warranty

In December of we bought a home from Vicini building company, who is owned and operated by Frank Miani of Macomb Township MI. Even though the home was a brand new model, we still had a home inspection done with numerous items being identified as needing repair. When we approached Mr. Miani regarding these issues, he assured us that he would take care of all of the repairs before our 18 month warranty on the house expired.

A "punch list" was sent to Mr. Miani along with pictures of the repairs needed before the 18 month expiration date, along with several phone calls, e-mails and written letters, including face to face meetings with him when he was in our subdivision fixing other homes. Although at the time, he did promise to fix everything on the list, he has never made an attempt at anything.

Just after the expiration of our 18 month warranty, Mr. Miani stated he didn't have any funds to do any of the repairs because he had 2 remaining homes to sell in our subdivision and no sales pending. He has since called us and stated that he doesn't have the funds to make any repairs at all and has refused to return any of our phone calls, and in the last 12 months, the last of his 2 remaining homes HAVE sold.

He has started a new subdivision 3 miles away, in Macomb township, under the new/old name of Regina homes. When he was still operating in our subdivision, he was represented by Keller Williams real estate. They also made numerous promises to us that Mr. Miani would stand behind the warranty, none of which has happened to date.
Starting in the summer of we had numerous high wind storms which have blown off many of the shingles on our home, this has happened to date 4 times, all of which we've had to pay for at a cost of over $1000.00 to us, and the licensed company that made the repairs told us that the shingles were installed improperly, resulting in the constant loss of shingles during high winds.

The two adjoining houses to us have also suffered similar damage. We have also had our great room ceiling leak, at this time (December), we placed a phone call to Mr. Miani to ask him who he had used as the original roofing contractor on our home. We made 3 phone calls to him, all have gone unanswered to date. We have contacted the builder's licensing department in Lansing Michigan only to find out that Mr. Miani is not, at least not at the time we purchased our home, a licensed builder. My advice to anyone considering buying a home from Mr. Miani, should have a lawyer present, and I'm not sure that would even help. Mr. Miani is apparently untrustworthy and not a man of honor.
