Stole money sent in by accident to invalid account numbe

I sent an electronic payment of $65 to an invalid Capital One account number. The payment was processed through my bank and Capital One will not apply the payment amount to my proper Capital One account or refund the money from the (my) bank account that it was withdrawn from.

I have spoken with customer service several times and have been told that they agree that the payment should be applied to my proper account number or refunded to the bank account that it is withdrawn from. However they do not have the authority to help me because the Capital One Payment Investigation Department must approve either action.

This was an electronic payment so I do not have the cancelled check. I have sent copies of the front of the check clearly made out to Capital One Bank (as opposed to Capital One Pymt) along with the other information they have requested. This documentation has been submitted three times. I am not able to speak with anybody in this department and each time I submitted documentation I receive their form letter back instructing me to submit the same documentation.

My documentation does not show the payment sent to Capital One Pymt, it shows Capital One Bank. My documentation also does not list a bank (Chase) transaction reference number, however it does show the payment which can be cross referenced to the check image by the check number in the list of electronic payments.

Capital One Finance Department acknowledges that the payment in question was processed (cashed) by them as a "mis-applied payment".
