Fraud, deceit, mail fraud, unlawful accessing bank account for payment not due, violation of do not call registry

Miscellaneous

First of all - ERS doesn't even know how to spell my name; this is my first clue. Since I have had trouble with fraud, etc. With a lot of different magazine companies, I have refused to talk to them. This was obviously a scam as they would have to know my real name but what probably happened was that they got my personal information from someone else. This all started when a magazine company called me at night and told me about their service and I decided it was a good deal since I hadn't had a magazine subscription in a long time. The second night someone calls that you presume to be the same company that you talked to last night and they even say so. They proceed to ask to go over your information again since something was wrong with their tape when they recorded me. I complied thinking this was the same company. The third night they called they said the same thing. I gave them the information but was a little suspicious by this time.

These people call you at night and harass you because they want another payment from you. I am on the "do not call" list but it doesn't seem to make any difference to them.

A little while after I received their first bill, they ask to update my information. After reluctantly giving them the information again without revealing my credit card or bank account number, they open up a new account for me (unknowingly). When they get to the end of the tape they want me to say at the end that this is a new order and I refused. At that point, they didn't like me saying that "this is not a new account", they would hang up the phone. Some of the companies will let you "pay them off" in the hundreds of dollars and inform you that the magazines will stop. After we pay them off, they have the nerve to call again (numerous times) trying to collect for our "other account" even though we paid them off in full.

Finally, they debit my bank account without authorization; this happens every month. The bank insinuates that they really don't want to get involved. The bank suggested that I cancel my account and set up a new one. Once ERS tells me that they are going to turn my account over to their attorney then the phone calls are almost everyday.

At last, I am so frustrated, angry and upset, I asked my husband to take the calls from the different magazine companies. They don't want to talk to him, they hang up when they know that I will not take the call.

I think they should be prosecuted for mail fraud, collusion, harassment, violation of the do not call law and any other applicable reason. Something should be done about these magazine companies - I hope some attorney would take on a class action suit.
