Bank Of America
Misapproprited a $14,300-online-credit transfer from my checking account to my VISA by covertly debiting it

Miscellaneous

Without any notification whatsoever. The transfer was not intended primarilly as payment to my overdraft protection VISA which had only a tiny balance at the time. The online transfer was absolutely routine with no caveat pop up whatsoever. Therefore, it had to be a credit, per force.

When I discoverd the transfer had been debited, I was advised during a frenzied phone call to the Bank of America that I had spent the money. I denied having done so. The Bank, however, could neither name the requisite payee nor attest to any consideration I had received for my $14,300 in cash. I was told only that the transaction was equivalent to my having spent the money on a new automobile, regardless. I suggested the Bank employee had taken leave of his senses (and I cleaned that one up).

A short time later at the indicated branch, it was obvious the staff had been advised of the problem and anticipated my visit. This is verbatim: "So who is going to reverse the transaction for you! We're not; the credit card people are not! So who is going to do that for you?" "That is what I am here to ask you!" (Note: at that point, 3 Bank employees had verbally acknowledged the transfer had been debited.

Later, the Bank denied having done so... in writing... And, in two or three subsequent trips to the branch, I have not seen the person who did so there.) Later, the Bank "explained away" the sudden and huge balance in my VISA by claiming I had asked for an equivalent cash advance! That is a fraudulent fabrication.

The Bank has purgered itself on an number of occassions during this on-going dispute. I am in the process of seeking help from the Comptroller of the Currency which thus far has taken the Bank's side believing their trumpet-up account entries to be valid. The Bank has left me insolvent and knows I can ill afford simple justice. I am a 76 year old pensioner.
