Sent down payment to company car never financed

I paid a visit to a dealership here in the city of Fayetteville, North Carolina and began the process to purchase a 99 Lincoln towncar with National Auto Sales whom decided to finance through a finance company by the name of Auto Credit Solutions. The general manager Warren Cornell stated this was a new company whom they have just started using and my husband and I were the first customers they were financing them with. We asked were they sure we would not be had due to this being a new company. The owner Larry Wright and the general manager Warren Cornell reassured us that they would make sure we get the car or our money back. We were told to get a money order or cashiers check for 10% of the total sale price which was $12,123.60 made out directly to Auto Credit Solutions this contract was processed over 2 years ago February 27. After getting the cashiers check everything was then overnighted to ACS the dealership never received a call pertaining to our deal and never received a check for the car so the dealership never submitted them the title for the car. We sat in the dealership for hours on the phone back and forth with different gentlemen in the office at ACS they were rude, nasty, and using profanity back and forth with the owners of the dealership. We knew at this time that we had been had and lost $1212.00. We then asked the dealership to reimburse us the funds but of course they did not stick to their word either they immediately stated you made the cashiers check out the ACS and not us so you need to get your money back from them. We took the dealership National Auto Sales to small claims court here in North Carolina and was denied the funds due to the cashiers check was made out the finance company and not the dealership. So we are out of $1212.00 and never did get a new car because we no longer had the money to get a car thanks to ACS.
