Ripoff, entering information wrong, NOT doing what THEY SAY

My mother-in-law bought this house and EMC bought the loan from Acustic Home Loans. My mother-in-law had a breakdown and left the house in foreclousure in Feb 05 after signing it over to us she gave us a power of attorney for the house along with a quit claim deed and a letter of authorization that we sent to EMC.

I contacted EMC and explained the circumstances and that we wanted to put this into a repayment plan (forebearence) and they did. I paid $3300.00 down and $1875.00 a month in July of 05 until Dec of 05 when they took it out of foreberrance and modified the loan.

I talked with Ron Devoe and Kami who assured me that my name would be listed on the LOAN so when I called there would not be any problems getting info or dealing with the account. Also when EMC would call they would ask for me NOT my mother-in-law since she lives in the east somewhere. They also said I would get a letter in Feb 06 about the account and payments (which I never did).

In Feb 06 I called EMC to see about the letter and payment and was told I was not on the account and they could not tell me anything but they could take my money, I said no and ended the call.

After that in Feb 06 EMC started calling asking for my mother-in-law, when I advised them she did not live here they hung up, when I was able to talk to them breifly and explained to them that I was supoosed to be on the account and I was the one that had it in forebearence and got it out of forebearence and I was the one making the payments. They informed me They did not see me anywhere on the account. NO POWER OF ATTORNEY nothing.

This went on for 4 months and I called KAMI who said she understood why I did not make my payments and looked at the computer and saw I was not on there and said she would check on it and call me back. Two days later she called me back and said the person who ENTERED the info at EMC entered it WRONG but it was corrected now, I even had someone else call me from EMC to verify my info so we did.

Now they called me to see about payment, I explained to them the problem and they still insisted I should have made the payments even if I did not get to know info on the account or if my payments were even posted, they refused to acknowledge that they made a mistake or even try to work it out, they wanted the behind payments of $8400.00 or another forebearence and I would not do it, so they put it into forecloseure.

I have tried to get someone to call me back now for 2 weeks and they say 24-72 hours but NO ONE HAS CALLED. I called them today and talked to APRIL CALLAHAN and she insisted the same thing I should have made the payments even if my name was not there and that EMC can make mistakes but the CONSUMER has to pay for it. EMC now wants to put us in another forebearence or us pay $13000.00 to reinstate the loan and pay for there mistake.
Our house is to sell on SEPT 27 06 and we have 4 small girls and one with heart problems and EMC does not care, can anyone help here in Oregon? Emc must be stopped from doing this!
