Miscellaneous

Instead of repeating was has been said, I will just say... Ditto to all.
New information that may get this company to start playing by the rules in Ca and US Federal laws - because they are offering and selling product across US, they are subject to interstate commerce clauses; which means they could be sued in Federal Court, plenty of potential plaintiffs with diversity and one could argue they have violated numerous laws regarding adequate, accurate and fair disclosure when selling a product. Note that on their website, the customer service button does not link to anything; nor does the email address info@ecigs.com link from the T&C page which you need a magnifying glass to read. And when you read it - because they don't offer it easily for you to read - have to search; they state that if u want to return a product in 30 days - which I arranged to do today; they did tell me about the 20% restocking charge and that it may take 30 days to get a credit of $95.66; however, contrary to what I was told on the phone - when I asked what kind of condition did the item need to be in for credit - having used the trial for about 16 days thinking i got a nice device for $4.95 and presumed they would make their money by selling me replacement cartridges (imagine I am telling u what you were thinking) and then when I see a $119.95 charge on my bank account I called - and then learned what they say below the check box on the home page - which by the way notice they are merely asking you to confirm you are over 18 and the box is before the text below which talks about the 14 day trial - (i didn't notice it when I checked the over 18 box mainly because there is so much text on the homepage I stupidly thought the fine print was something to do with nicotine. Nevertheless, the guy said no problem you will get $95.66 back. Now that i have read their T&C (the hidden one linked from the bottom of the home page) it says,
"The items must be returned in the same condition as received. Any damaged product may void issuance of refund."

Last i want to point out that on the homepage they show an address in Scotland. On the T&C page they say their "main office" is in Escondido, CA. They say their international office is in England (not Scotland) and then in the fine print of the T&C is says if you have a beef, you have agreed to arbitration, which you also have agreed to pay for unless the arb agmt says otherwise - and finally, you have agreed to arbitrate in Denver, CO.

Initially I was perturbed but felt the stress wasn't worth the $25 plus postage I will spend if I get it back to Arizona (oh, yes - yet another location) by the 7th (now wondering if the guy on the phone can be trusted - since the T&C says they aren't going to issue a credit - because I "tried the trial" and paid for the trial and btw, on the home page they state they are 100% guaranteed, money back - but fail to give you the holes which is hidden. And last but not least - when the product came from the supposed starter kit for $4.95 - you may remember there is not a single piece of paper inside that reminds you it is a 14 day trial. When I asked the man on the phone why they don't provide that information - including an address where to send it back -

His answer, "that would be wasting paper and killing trees" - no lie, I swear that's what he said. So, now that I have learned so much about a ripoff company - that actually has a good product - until you realize its a gazillion dollars to use it. I can't even imagine what would happen after your monthly charge for 5 canisters if they were lost in the mail or didn't work.

I think its time to file a complaint with the Attorney General of California and let's see if they can become real human beings after they are asked to talk to the AG. Anyone in - let me know. Good hunting for a replacement product... Brian
