We had purchased a service Contract from Desert Valley Airee, Inc. On 4/11 for $1,000.00. Had one (1) service performed on 5/1 by tech Alex 623-202-8416.in 1/26 my wife had sent as personal check for the monthly payment of $32.00 and included $160. Oo for $l62.00 for 6 months advance payment. Evidently the contract was either sold to or given to Capital Retail Bank, Inc. And we had been contacted by them for being delinquent in payment!!?? They said we could not pay on the principal for more than 2 months. I told their collector if that was the case to refund the excess amount to us and she acknowledged that they would. We never received any refund only a dunning letter. I had asked their collectors and collection manager to show and proved to me where I signed anything agreeing to a pre-pament-penalty clause agreement!!! They said that they would not... They don't do that!!?? My wife theen called the Desert Valley Aire, Inc. She explained the situation to their receptionist who in turn looked for the sales papers... And conveniently could not find them but will try and then call us back! I am hesitant to file a claim towards (Desert Aire) because if they are going to service my air conditioner it may very well get damaged by their techs as it seems they are only trying to sell us a new air conditioner unit (on top of my house). Please look into this matter and seee if you can get us a copy of the document that show my signature approving and agreeing to a pre-payment clause! Thank you! Jack F.
