Desert Toyota breach of contract ripoff deception

On or about July 3 I applied online for a lease with Toyota Motor Credit. I was told to contact desert Toyota. A meeting with a representative (Glen Miller) was set up and at that meeting he told me that he could not finance the vehicle. Several days later I got a call from "Lisa" on a survey. I told her what happened. She said she would talk to her manager and call me back. When she called back, I asked her what she could do. She said " send you home in a new truck today".

I made an appointment to go in on July 15. At that time, I made a lease agreement with Desert Toyota and gave them a check for $1,000 for the down payment. Several weeks later, I received a call from "Billie" asking me to come in and "finalize the deal" I asked what it was about, and she told me she needed additional papers signed. When I went in, I was told they couldn't make the deal that was previously agreed to. But could finance me at an additional $150.00 per month.

I stated we had a contract that was binding on BOTH parties and left the premises. I have spoken to Desert Toyota Representatives trying to get registration papers to register the truck without success. On August 14, which was the last day to register the truck, I still had not received the necessary paperwork and filed a complaint with the DMV and received a 10 day extension to register the vehicle.

I believe Desert Toyota was unsuccessful in selling the lease agreement to a third party and is therefore attempting to back out of the lease agreement, however, my lease agreement is with Desert Toyota and is not contingent upon them selling the agreement and contains no language to nullify the contract in the event they were unsuccessful in selling it.

The contract is mutual binding and Desert Toyota needs to honor its obligation under the contract and its requirements under the law to provide the paperwork necessary to register the vehicle.

Desert Toyota threatened me that they were going to report the vehicle stolen. I told them to go ahead I had a valid contract whether they wanted to honor it or not. Desert Toyota did not provide the necessary paperwork to register the vehicle and the DMV would not grant another extension. Therefore with the assistance of the DMV I returned the truck to Desert Toyota and under pressure from the DMV they returned my down payment.

I am still considering filing a lawsuit against Desert Toyota for misrepresentation and unlawful sales tactics.
