UPDATE: After filing the necessary paperwork with the local small claims courthouse, we received a court date. Exactly one week before our court date, June Hannaford (landlord of Eagle Country Apts) requested that we settle out of court for half the amount owed to us.

After seemingly endless debates back and forth and tiring negotiations, we settled for $1,500 of the $3,000 originally owed to us for unlawful rent increases, damages, a $400 electric bill received when she came into our apartment and turned the thermostat up beyond 70 degrees - heating the outside since the large sliding doors were removed and only one sheet of plastic was covering the opening - and the security deposit owed and last month's rent reimbursement.

It was agreed, on June Hannaford's terms, that she would make 3 payments of $500 on the 5th of the months of June, July and August. We received one payment of $500 on June 22nd, 17 days passed the due date. We never received the other two payments, so we filed a contemptment motion. The court granted this request and set our court date for mid-October. We weren't required to attend the proceedings, which we were happy to hear since neither my husband or I could afford to miss work.

We received a letter from our attorney a few days later stating that the judge had granted June Hannaford a new judgment of $50 per month payments spread over 2 years. We were livid! And we couldn't fathom how this judgment could be called justice.

#1. June Hannaford was in contempt of court for a settlement SHE negotiated; the terms were hers, not ours.

#2. She was required to bring a financial affidavit to court, stating her assets and property. She claimed that, other than the now empty apartments, she has nothing. She placed her corvette in her boyfriend's name. The rest of her assets she placed in her son's name: snowmobiles, fourwheelers, camper, full-size truck, tanning bed, and more.

#3. She claimed to have no money in the bank. Reason: she does NOT work! Not even part time! And yet the judge didn't even suggest that she get a job to pay off the lawsuit.

#4. The judge had all the necessary information to prove her neglegince in this matter: bank statements proving that she never deposited our deposit of $1,800 (first month's rent, last month's rent and security deposit) and instead spent it.

The judge also had MANY dated pictures of the destroyed sliding doors with plastic covering the 5x7ft gap, pictures of the 8x5ft hole in the ceiling with exposed wire and piping. He also had a copy of the restraining order placed upon her for unlawful entry into our apartment numerous times, a copy of the electric bill of $400 for only 2 weeks since she was turning up our thermostats well beyond 70 degrees and at our expense.

The judge was also given the original settlement conceding to her terms, all the letters of unlawful rent increases every 3 months or so, all the complaint letters we had written in regards to the backed up septic bubbling feces into our tub for a total of 2 months, the sliding doors that leaked and flooded the kitchen floor for 2 years, the kitchen ceiling falling in, etc.

And yet he still greatly reduced her monthly payments from $500 per month (which she had originally suggested during the settlement) to a mere $50 per month. The judge further added insult to injury by allowing her a time frame of 2 years to pay it off! And this is called justice?

Her first payment to us was due November 15th. We didn't receive it until December 2nd.
