I have decided to warn anybody and everybody that I can, against using LOAN-MAX title car loan company. They do not abide by the simplest and most common laws. For instance, F.D.C.P.A. This stands for "Fair Debt Collection Practices Act". No matter what anybody tells you, we all have a right to not be harassed by a collection agency! I was laid off from my job a couple of months ago, which made it impossible for me to continue to pay my car title loan payment. I am not a deadbeat which does not pay her bills. However, times are hard, and even though I kept in touch with the collection office, they continued to call me EVERY DAY. The fair debt collection act prohibits this, or should I say, it's designed to. I also live in a very small community, it is IMPOSSIBLE for me to get back and forth for work now. I do not have family or friends locally that can transport me to and from work. Talk about a catch 22. The whole reason I did the car title loan was to get work done on my car that I could never afford without the extra funds. The local office I dealt with has an extremely rude and unprofessional manager. Sarah, the manager, was unavailable on several occasions that I called their office. I finally got tired of her attitude and just dealt with the man that called me from the Georgia based corporate office. He informed me that even though I answered my phone and explained my situation and intent to pay this off with my taxes, that they would continue to call me EVERY DAY. Sir, you broke the law and I know my rights. I was a collector for an agency that collected on student loans for the Dept. Of Treasury. I know that if they call you to collect and you speak with them, they are NOT ALLOWED TO CALL FOR 7 days. So get ready LOAN-MAX, here I come. I REFUSE to be a victim to someone who claims that I have defaulted on my part, but they are allowed to break the law!!! Anybody whom has been in my position, I urge you to pursue a claim against this company. Don't give up, it's worth the time to show them that they can't just make up the rules as they go along. If there any attorneys in my area interested in helping me with the case please contact me. I have spoken to a couple of attorneys and have not decided which one I will go with yet. I want a cut-throat attorney whom believes in justice for people who are being harassed by companies due to collections. I was charged a n interest rate of 263%. I agreed to the terms when I signed, but I also signed their disclaimer that claims they would abide by the "Fair Debt Collection Practices Act" in case of default on the loan. They are playing a game and I for one am not ready to lose! If you expect me to not alter from our agreement at all, no matter what, then YOU will not alter from your agreement that you rushed me to sign! Know this, LOAN-MAX feeds off of desperate people. I may have been desperate, but I am by no means stupid. I have a friend that brought to may attention on my receipts from payments made, that my payments were inconsistent with the way they should have been credited towards the interest. THIS COMPANY IS A HUGE SCAM!!! THANKS for taking the time to read this. God bless!
