Ripoff paid for computer & never recieved

On 2/13/03 I paid this guy 1700.00 to build me a computer & I have yet to recieve a computer! I have a reciept as well as a copy of the certified checks that I payed him with. Isn't this theft? I'v told him that I would take him to court over this matter & he tells me that I will never win, and that If I take him to court that after I LOOSE that he will turn around & sue me. For what I'm not sure. Can people just get away with this. What should I do? I hope you guys can help.
