Ripoff Dishonorable Business! Refuse to honor warranty on a computer that simply STOPPED working!

I paid $1460.00 for a computer that I bought from this company in April of 03. At the time the company was changing its warranty from 3 years on comps, to 1 year. This was NOT noted on their website. I found this out when I called to place the order. I told salesman Eddie Maldonado that what made the computer so attractive me besides the good reviews I had read about the company, is the warranty. For a 1 year warranty, I can get a comp from Gateway which was located just a couple of miles from me, as opposed to ordering a computer from California. I live in NY.

This was March 03 and the new warranty would go into effect in April. I told him that I wanted to buy the computer, but that I would not have all of the money for it until the first week of April. He said they would honor the 3 year warranty since I had contacted them about the computer in March. I was very thankful for that.

The computer arrived, and the invoice said 1 year warranty. I called EM several times about this with him insisting that the invoice he sent me lists a 3 year warranty. Then he insisted that he had sent out a seperate invoice, which I should have gotten in the mail.

After several days of this, I told him that I wanted something in writing. He sounded bothered that I would not trust his insistance that my account was documented to say that I have a 3 year warranty. Finally I told him that if I did not get anything in writing TODAY, I would send the computer back! Later, I got a faxed invoice with a handwritten note in the middle of it, "3 year warranty on complete system" dated 4/16/03 and signed by Rosemary Castro.

Well, Since then, I have had some problems with the computer, that I felt were not even worth dealing with their inconsistent tech reps. The one thing that did happen every now and then, that several other people had complained about on another site, is that my comp would just restart on its own while I was in the middle of a document. The wireless keyboard and mouse stopped working after less than a year. But none of that was so bothersome as the annoying GRINDING that started coming from the hard drive. Well, on 9/1 the computer simply POOFED! I have not been able to turn it on since!

I tried to get tech support, but you guessed it... According to them, I have only a ONE YEAR WARRANTY, which of course expired in April. I called this company a few times, was on hold forever before I finally got on the phone with Maria Gonzalez. She told me to fax a copy of the handwritten note signed by Ms. Castro and that Ms. Castro had been a supervisor there.

I tried the next day when I got to work. The fax just rang and rang. Then I called the number on my cell phone. It rang and rang. I did not hear the long tone that indicated it was a fax machine. I called Ms. Gonzalez back. She said maybe there was a problem with the machine, to try again. I did. Same thing... Called left a message for her saying that I am tired of dealing with this company... Asked her to call me back. No call.

On 9/3 I spoke with a customer service rep. Named Al. Told him the situation. He said he would check on fax machine. And stayed online while I tried to fax the invoice. It went through. He said there was no paper in the fax machine, and that was why I was having a problem. He had the fax in his hand, and said that he would give it to Maria, and things should be ok. This was late Friday while I was at work. They do not have any customer service on Sat, as far as I know.

Last week, I went to my martial arts classes instead of coming home to get this situation settled. Currently, I am using the ABS monitor with my 97 IBM Aptiva which has not let me down! Tonight, I skipped my class so that I can come home and call tech support. I am here writing this instead of getting help because of course. According to them, I have a ONE YEAR WARRANTY!

So I have this expensive computer that is just sitting in the middle of my office. I have left home, cell, and work number for Ms. Castro. I have yet to have her return a call since having first spoken to her on 9/1. This last call, I told her I would contact consumer advocacy grups and look into filing a small claims case against them. I will talk to a lawyer at my job tomorrow about that.

I am sure I should take the computer into a local place and have them look at it, pay for it, then bill ABS. But, I just don't have the money to even start that process, and I should not have to. They should honor their warranty. Buyer BEWARE!
