I had Clear Network as my internet/phone provider for almost a year.in December my phone and internet went down. I phoned Clear Network and was told that they were having problems with a transformer and I would be back in service within 24 hours. I called them every 24 hours for three days and was told the same thing. After the third call they said they were having a problem with their transformer being able to get a signal to my area and it might take two weeks to be able to get a signal. I told them that I could not go two weeks without phone or internet service and that they needed to cancel my account and I would find a different provider that could actually provide service to my area. At that time they said they would not incur anymore charges to my account and they sent me a prepaid address label to return their equipment back to them.

I did send the equipment back to them and didn't hear from them until 3/6. They sent me an email saying "Thank you for choosing Clear Network and thank you for your $40 payment". I pulled up my bank account on line and saw that they had charged $40 to my visa account. I phoned them and asked them to refund the $40 and they said it was a legitimate charge, as I had cancelled my service with them before the contract had expired. I told them again, that the reason I cancelled my account was because they were not able to provide me the service I was being charged for. They gave me a refund ticket number and said that they would get back to me telling me whether I would be eligible for a refund. They never got back to me, so I have called them multiple times and still no refund. Today when I phoned, I asked to speak to a supervisor. After being put on hold for 15 minutes, the same person came back to me and said that her supervisor told her that the fee was legitimate and her supervisor told her to tell me it was a "restocking fee".

I have contacted my bank and cancelled my credit card so that they can no longer charge anymore fees to my account, but I still want my $40 refund.
