Ripoff Trying to find ways to get my money or phone from ebay sale, or bring this fellow to court!

Hi this is Nemoy from Toronto, Ontario Canada and I would like to have some information about a problem that happened with me thanks if thats not a problem.

On July 31 i decided to purchase a phone from the online auction site ebay.com and I came upon an auction of a phone that I really wanted, a Samsung V206. The auction stated that if any buyers wish to buy the phone right now and end the auction should contact him via email. I did so we agreed to buy the phone for $230 US with shipping to Toronto, Canada.

So I advised the seller that I was going to be making payments through money order that we agreed upon. It was bought on July 31 and was mailed regularly the same day.

I went back to the bank to inquire if the money order was cashed on the 8th of August and the teller notified me and said yes it was and agreed to print me a copy of the money order transaction which stated the day it was bought and when and who cashed it.

So I have been contacting the seller and I have not gotten any answer. I was contacted by another bidder on the phone which later stated that he had also sent a money order on the same exact phone and said that he has not gotten the phone as of yet.

I was surprised and so he had the seller's phone number which he gave to me and I called. The seller, Kyle Kuroyama, told me that he had sent the phone out 3 weeks ago and doesn't know why I have not gotten it yet. He stated that it was sent via UPS. I said I have gotten nothing. So he said that he was going to provide the tracking number for the item for me on Monday the 25 of August. I spoke to him on the 22nd of August and now it is August 26 and no answer.

I have sent him numerous emails and no answer and I called him back on Monday and the AT&T operator advised me that this number is no longer in service so I have had it!

I am trying to find ways to get my money or phone or bring this fellow to court so I have all evidence if requested. I would really like to hear back from you guys please by using the rebuttal box. Thank you. Asap.
