Finishline Company refuses to issue refund for shipment that was refused and sent back to them!

On 05/13/09 I placed an order with the "Finishline" company for (2) pair of basketball shoes. I later decided to get a different brand from a different company so I phoned the "Finishline" company to cancel the order. They informed me it was too late to cancel because the items had already shipped out however they informed me that when the package arrived to refuse the shipment and when it was received back they would issue a full refund. The package arrived on 05/14/09 by UPS tracking # 1Z7E438E139810905. Due to my work schedule and other obligations at the time I was unable to drive the package back to my local UPS office until 05/18/09. UPS inspected the package and weighed it and wrote refused return to sender on the box and off the package went to Oklahoma City, OK. The package arrived back at "Finishline" on 05/19/09, and was signed for by someone by the name of Ballard at 11:48 A.M. The company contacts UPS and reports that the merchandise is missing from the box and that the box is damaged (see UPS manifest). The company is now claiming some 2 months later that there was other merchandise in the box other than what they shipped out to me and refuse to give me my refund. I explained that UPS does not take packages back marked refused if they have been opened or tampered with but the company has dug their heels in this time and absolutely refuse to issue any refund. They are accusing me of committing fraud. I told them that it is posible that UPS or one of their employees tampered with the package but I never touched it or tampered with the package. I feel the company is playing games with me and falsely accusing me of something I did not do just so they don't have to issue a refund. I spoke to a Roger Underwood of the Corporate offices and he was just about as imcompetent as the people in customer service I had to deal with. They were all rude, disrespectful and uncooperative. I have find a complaint with the BBB in Indiana and have told them that this could end up in court. The company seemed like they didn't care what happened. I am very frustrated and upset by the whole matter and feel the company should issue me a full refund as soon as possible.
