Website designer he would redesign my website within 48 hrs and he never did nor did he return my calls

I was looking to get my website revamped and just needed a template to be loaded onto a my existing site. I also needed a service where I can update my own photos into a gallery. I came across emagefolios.com and thought the price was reasonable for redesign of my website and had the services I needed. So, I contact the site and purchased the template for $280 with the service and talked to the website designer for awhile about the details. He told me to send him content information and information for my hosting so he can load the site. I did that and I call him later and left a message letting him know I sent the info and ask if he needed more info. I never heard back from him, the site was never revamped until now (I used another service called Dripbook which is easier and more affordable). It has been since February that this has happened and never heard from him since (maybe through a text stating that he was overwhelmed). I keep calling and leaving messages and sending email messages. I even went to the Atlanta BBB and they never heard from him. Now I am out of $280 with no satisfaction at all and I just want my back now.
