Would not honor 45 return policy Los Angeles

I purchased 3 elliptical machines from these guys 1/08/08 invoice #72807.
I received all 3,2 of them looked great and are doing great. The 3rd, it looked as if it was a refurbished unit with alot of scratches that looked like they had been painted over. I was told when I purchase these machines, I would have 45 days to return for ANY reason. I called and requested to be picked up. Here is where the run around began. They immediatly told me to contact the manufacturer. The manufacturer was very nice, but he told me that the only way they could exchange the unit was if I sent pictures of the damage and they would decide if the unit needed to be exchanged. I was not happy with this because fitnessblowout said I had 45 days to return for ANY reason!
So I called fitnessblowout back. I talked with Nic in customer service, and he said no problem, they would get it taken care of. Never happend. I called them back and this time got a "manager", Augustine. I told him the problem and he said I was being unreasonable. He said, "here is what Im gonna do"."Im going to send you a bottle of paint, and you can touch the machine up. I said no, I want to send back.
When they shipped the 3 units to me, it was a total charge of $221.88 to send 3 to me. He said if I send back the 1 unit they would charge $443.76 shipping. I said at that time what if I want to send all 3 back, he said and I quote, "you will be charged $443.76 times 3, how about that?" Then Super Jim, who knows if it really was him, emailed me and said that he had talked to Augustine and he was a model employee and told me to contact the manufacturer, so even the owner will not honor the 45 return policy. Beware!
