They want me to pay a TERMINATION fee when the service NEVER STARTED! Ripoff

We live in a no mans land for high speed internet. We have used Earthlink dial up service for many years. When Earthlink called and said they could offer DSL we jumped at the chance.

Earthlink sent the modem and ethernet cable as promised. I hooked it up and we could not get a DSL signal. I called Earthlink and they sent a technician out to our house. He said that we were too far from the source to get a decent DSL signal. We would get a signal for a few seonds then it would go out. The light on the modem was continually blinking with it trying to find a signal.

I called Earthlink to cancel DSL. They said in order to cancel it WITHOUT having to pay a termination fee I would have to go through their level 4 technician. I did so. After many hours on the phone. I have the phone records to prove it.

They sent a second technician out to our house. I did not meet him. But the level 4 technician said that he came to the same conclusion as the first one, that we were too far from the signal. (Our house is at the top of a hill and the signal comes into the office of our complex, at the bottom of the hill.)

Earthlink agreed I could send the equipment back with no termination fee. They sent me a letter and a UPS label. I complied.

Then I received a termination bill. I wrote Earthlink a letter explaining the lengthy process I had endured. Sending a copy of their own letter. This was last month.

So this month (August), I receive a COLLECTION bill? Earthlink is NUTS. They have not even answered my letter. Is that how they respond to a letter, to report someone to a collection agency?

I am FURIOUS. We were good customers for many years. I don't think they even read my letter. How on earth can they expect me to pay for something I never had! Something they promised, but never delivered?!

I never signed a contract with Earthlink for DSL. This is extortion. This is fraud!
