War Rock Selling what they can not deliver

Let me start by saying that I have played War Rock since the open beta started over a year ago, and it was a great game, plus it was free. The game had a few bugs at first, after all it was still in beta testing. We beta testers were urged to send bug reports, and I did, faithfully.
As time went by the game got better and better as the bugs were worked out.
Then they announced that the full retail version was being released. I was happy to fork over $20.00 since full retail player got a free month of Premium Gold Membership, extra weapons, a clan system, more experience points, bonus in game money, a map book and some silly dog tags.
Mind you the game is still free to play, I just wanted the extras.
Thats when the problems started. From the first time I tried to play after installing the game, it would crash to the desktop. So I read through the forums for a workaround or a fix. No help there, it only said "be patient, a patch is on the way."
I waited a few days and they released an update. The update made the game worse, it would play for about 2 to 10 minutes before freezing up. So I checked the forums again, and everyone was having the same problems.
So then I submitted a trouble ticket and got back a canned response to "be patient." So once again I was patient for another 10 days or so. They released another update which did nothing.
By now my free month of Gold Premium Membership was about to expire so I posted a question in the forums asking if Premium Gold Memberships would be extended due to the fact that the game was unplayable. They told me that I was being an instigator and I should not post questions like that.
I was angry so I posted that I felt I was ripped off and I was banned from the forums.
So I submitted more trouble tickets every day since the game did not work, and they told me " Stand down soldier."
So I read through page after page on their website until I found a physical address to reach them.
I wrote them a letter asking for a free month of Premium Gold Membership to make up for the month that I paid for but could not use. I was told "sorry but we are unable to do that."
So I wrote back asking for arbitration, like it says to do in the EULA. That was a month ago and I have not heard back from them.
I guess my next option is to sue them in my local small claims court.
They are not a nice company to do business with, so be warned.
By the way it has been 3 1/2 months and the game still does not work right.
P.S. Before someone asks, my system far surpasses system requirements for the game.
