Trying to press charges when item got stolen from my car

I rented a labtop from rac and the night I went to return it for a new dell labtop I was waiting to come in. I got there and realized it was gone and it was there the night before I went to the police department filled a report and rac is saying if I dont pay they are filling police report tomorrow can they prosecute for this??? WHat do I do I refuse to pay for item I Dont have..
