Ebay ripoff, never sent ring, no reply, no answe

I won an ebay internet auction for a diamond ring offered by an internet company called Gems Within or gemswithin. The listed asked for prompt payment by check or money order, so I sent a money order within a couple of days of close.
I received an e-mail from the rip-off artists a week later saying that they received the payment and that they would send an e-mail when the item was shipped. The listing promised shipping within 7 business day.
Thirty days later, they won't return e-mails or phone calls. That was a good one. After contacting ebay and getting their contact information, the persons name turned out to be "Diamond Santos".
