Ripoff Stole my money! Bait and switch! Don't be swindled by MS software fraud

This eBay seller purported to sell "NEW Microsoft Windows XP Home SP2, Full w/Legal COA" and pictured an authentic Microsoft XP Home CD. What arrived was a Dell laptop restore CD. What's more, the CD was shipped unprotected in a bubble envelope via USPS. Needless to say it arrived severely scratched and snapped in half.

Problem One: Seller has refused to refund my money for the broken disc. He claimed that he would send a replacement disc but he never bothered. At this stage he has stolen $76.

Problem Two: Seller never mentions that he is selling restore CDs; rather, he pictures a real Microsoft XP Home package and CD.

Problem Three: Many restore CDs don't work on any PC but the manufacture's unit (in this case a Dell laptop). The seller claims that it will work but I'll never know since the disc arrived broken in two. Here is the seller's explanation:

"It is a Full install. And it will work on non dell pc's... If you are wondering where i get these disk from I buy Dell computers in bulk and set them up for other companies like Walgreens and Wal-mart and schools. Companies use Windows NT and not XP. So i just peal the COA off and sell the WIndows XP CD's. Just to let you know if your wondering:)"

I am in the process of checking with Microsoft's antipiracy department to determine whether these sales are legitimate. I'll update this consumer complaints when I get a response.

I was initially hopeful that seller was responsive and helpful. His early emails stated: "My goal is to make you happy, please write back." However, when I received no refund, replacement disc, or responses from the seller, I filed disputes with both eBay and Paypal. At that juncture his tone changed:

"Apparently your an idiot. Quit e-mailing me. Call Microsoft and find out there shipping info and MAIL the broken CD with it's COA and see what they say. I am blocking you because i don't believe a da* word that comes out of your mouth. If you did work for there leagal department you would know it's legit. Quit lieing and crying and quit trying to scam me. Worked for there Leagal department my a*, sh* you can't even spell it correctly."

This is not the type of seller that we want on eBay! Avoid him at all costs.
