On April 9 I ordered a bicycle from justbicycles.com. I received an order confermation on the 11th and began waiting for my delivery. The order confermation stated that I would receive a tracking number when the bicycle shipped.

On April 13th and 15th I sent e-mails requesting the tracking number for my order and received no response. Between the 15th and 22nd of April I left several voice messages (this company does not answer phones) requesting a return call.

Finally, on April 22 I sent an e-mail telling this company that I was contacting my bank and disputing the charge because there had been no contact, which I did. My bank said they would reverse the charge and look into the issue.

On 4/26/05, after the dispute and my e-mail telling the company that I was canceling my order, I got a tracking number, which was not valid. I e-mailed and told them not to send the item and that I would not accept delivery because I bought a bicycle at a local vendor.

This company's response is pasted below:

I told you that the tracking number was being obtained from the manufacture and I would provide it. The correct number was given to us today. It is 122338830010526. As you can see it was shipped previously and will deliver to you on the 30th. As to your threats of posting things please do and see what happens. The policy on returns is there is a 30% fee. There is no exception for you. You can 1) accept the bike and pay for it, 2) refuse the bike and be charged a 30% fee per the website, or 3) neither and have us enter a charge off on your credit file. There is no exception because you threatened us or any exception because you feel you need stroked.

Finally, there is no reason to email further. You know what the options are and what the consequences are.

As you can see from the print screen below, the item has not yet shipped. I have canceled the order prior to shipping. My bank has assured me that I will not be responsible for any fees because the charge was disputed prior to shipping. Your 30% fee is listed under the "return" section of your sales agreement. I am not returning anything. I am simply canceling the order because you company has conducted this transaction very unprofessionally. A simple reply to my e-mails requesting information, or a return telephone call, would have allowed us to avoid this situation.

Your threat of affecting my credit has truly made me feel that doing business with your company would be a terrible mistake. I will be sure to post copies of your e-mails on as many message boards as possible.

Your choice but it goes on your credit as a uncollectable debt. Doesn't matter to us one way or the other. If the bike is refused we will charge your card the 30% cancellation fee per the website contract you entered into. If your card does not sustain the charge it goes on your credit as a charge off.
