Capital fitness Refuse to reimburse medical bill after injured at xsport

I was injured at the logan square xsport, due to the negligence of other members thowing weights. This happened in front of numerious employees of theres, personal trainers, towel guys, etc. I sent a bill to capital fitness, as told to from Nancy. The bill was for $1300 or so. All I recieved was a BS letter that they are not liable. I don't think it is my responsability, to inforce there rules. Also I don't think in a time that I need medical assistance I should have to get the information from the guys throwing weights around. I would think that a employee would do that. My lawyer tried contacting Nancy numerous times, and she never returned a single call. This happened two years ago I have only regained a small percent of feeling in my finger. I do intend on taking legal action.
