Members Services Silkong, Rush Gym shady business practices, auto drafting credit cards without knowingly giving permission to do so

I joined Rush Gym on 04/29/09, the contract was a month to month membership, I paid the membership enrollment fee of $70.00 by credit card. My membership was $34.00 dollars a month starting payments due on 05/31/09.

The day I joined rush gym I told the rush employee who was signing me up that I didnt want any auto drafts or pay there extra $5.00 fee for paying at the gym. The rush employee told me that it was ok to do that, he said just pay your $34.00 a month at the gym and everything was ok.

On 05/23/09 I was at the rush gym, I went up to the front desk to make my payment about a week before it was due. I was told by the rush employee that I couldnt make a payment that their system wouldnt take it, I was told to come in on the day it was due, I said I probally want be able to be here on that day, then I said the gym will hit me with a late charge if I dont pay before due date. The rush employee told me to call member services to make my payment.

I called member services talked to a silkong she told me not to worry about the payment that rush gym was going to auto draft my credit card, I told her not to do that, that I havent gave permission to auto draft, Silkong said yes you have, and rush gym was going to do just that, I asked her again not to auto draft my credit card, she said no, silkong told me that I could pay my dues at the gym but it would be a extra $5.00 dollars a month to do that but this month is coming from auto draft, I told her I would stop payment which I have done, then she told me if we cant auto draft we will charge an exrta $15.00 on top of your $34.00 membership dues.

I told her that I want to cancell my membership, that I was sorry that we could not work this out, that I will be going to another gym, I also told her that I had been a member for almost 4yrs with rush gym and was in good standing, that didnt matter to her, she just said send me a written statement that you want out of your contract, I did just that today 05/29/09. So lets look at the cost and time for this gym hell I have gone through, cost so far $122.00 dollars. Time spent calling CC company, member services, written letter, driving to fax the letter. The only Rush I feel is anger!
