Bailey's Powerhouse Gym
Consumer Fraud, Breach of Contract, Injury by Employees

Health & Medicine

I signed up for a year long membership at the above-listed Baileys location.in June, about six months into my membership, I was severely injured my an inexperienced trainer at SWEAT PT on Baileys property. That month, I provided a letter to the gym manager at the time, requesting that my gym membership be terminated and I provided as proof a prescription from a local neurosurgeon. The prescription stated to terminate my contract due to my injury and inability to participate in an exercise program. The contract I signed with Baileys provided for this as a method to terminate. I did not so much as set foot on Baileys soil during this entire time in question.

I received no response, and Baileys continued to charge my card $39.00/month until December. There is incredible turnover at that gym, and I found out that the prior manager had apparently left without doing anything about my situation. I finally cancelled my debit/credit card because Bailey's refused to stop charging it, even after I spoke to the new gym manager and provided her with the same documentation on or about December. She was surly to me in front of other gym guests and refused to talk with me privately. She pulled out a folder on me, and in it, I saw my documents. I continued treatment with the same neurosurgeon, and I had him write a second prescription on December 15, reiterating that I currently should not participate and should not have been participating in an exercise program since June.

On December 18, I provided a letter to Corporate explaining my situation and again included a copy of the prescriptions from my doctor. Corporate did not respond. On January 29, I sent a certified letter return receipt to Corporate containing the previous correspondence and a copy of the prescription. A nasty representative from corporate called me and stated, It is your word against ours, and that they would not be refunding any gym fees. After numerous calls and letter, Baileys will still not refund the six months of gym fees I have requested.

Futher, Baileys has lied to several of my friends. When they signed up at the same time I did, Baileys assured them that they could cancel their contract at any time for a $50 fee. However, they did not tell them that this clause requires moving a great distance from any Baileys location, in addition to the fee. Also, recently, Baileys signed up numerous members during a month-end membership drive, only to switch from contractual payment to month to month THE NEXT DAY!!! Stay awy from this gym!
