Ripoff and how I got reimbursed

This is my step by step ordeal with white overnite and my process for getting my credit card company to reimburse me for the total amount.in the end I won... So keep records and correspondance to deal with this scamming company. The following is an exact copy of what I sent with my credit card dispute.

Enclosed please find a copy of my credit card statement indicating the transactions and contact numbers for WHITE OVERNITE. The second page I've enclosed is a copy of my phone bill indicating two calls to WHITE OVERNITE on 03/27.

The first 3/27/06 call (8 minute duration call), I asked for the $106.90 transaction reimbursement. My transaction extent was a free sample at a cost of shipping for $3.95. I did not agree to further shipments of WHITE OVERNITE or any further charges to my credit card.

The representative disagreed and said reimbursement would not be issued even if the shipment was returned. I informed him that I would be returning the product with delivery confirmation and issuing a dispute with my credit card company since I had only purchased the sample. The representative said they did not accept returns but I returned the product to the address from where the package shipped.

After the initial contact, I called my credit card customer service and asked that a dispute be filed on this charge. The representative started a case and generated that the proper forms be sent to me. On the call the representative also indicated cancellation and I realized that although I had complained about an unwanted shipmentI didn't verify that there would be no future shipments.

So I called WHITE OVERNITE again (3 minute duration call) and cancelled any future shipments. I didn't receive a cancellation number but the phone records indicate the contact and no further charges have been charged to my account.

I've sent the following concerning this case so far:

Copy of internet receipt (indicating only the free sample for $3.95 with no indication of
future shipments or charges, I have no receipt for the $106.90 transaction)
Copy of delivery confirmation receipt
Copy of internet track and confirm delivery
Enclosed: copy of credit card statement indicating contact number
Copy of phone records indicating contact

Today, 04/21/06, I again contacted WHITE OVERNITE. They pulled up my account and indicated that they had not received the return shipment. I conveniently provided them with the tracking number. Once, this was provided they did issue a credit of $89.95 with confirmation # 4563406. I was told this refund will take a while to show up. When asked why only $89.95 she replied that it is less shipping and handling.

I would like to dispute this $16.95 shipping charge. They have refused to refund this amount of the purchase. I didn't want another shipment. The internet transaction did not indicate that once I purchased the free sample for $3.95 that I would be responsible for an additional $106.90 purchase. I don't even have a receipt for this transaction nor indication on my original receipt of its future occurrence! This additional purchase took no regard of whether or not I wanted it! If I had known about the total commitment of $106.90 I would have NEVER ordered the sample.

I feel that the merchant's misguidance in the sample purchase is elusive, reckless and mischievous to the consumer. I shouldn't be punished $16.95 shipping due to the merchants' misguidance. If this charge continues, I am paying for their shipping as well as what it cost me to ship it back to them. I had to purchase packaging, parcel post and delivery confirmation totaling around $8.00 not their $16.95 supposed shipping cost. Please, fight this shipping charge of $16.95 due to the merchant's misguidance in this transaction.
