Deceptive selling practices! Buyer Beware! Scam!

I purchased a "new open box" from this company on 5/14/10. The TV came today and it is broken (shuts off and on randomly, HDMI connector is loose, and as of today there is no sound). I contacted customer service via several e-mails and telephone and they refuse to replace the item. They want me to contact the manufacturer to come fix the TV but I purchased it from their store. It is absurd that the SAME exact date I receive the TV, it is not functioning. Obviously they are in the business of selling defective TVs and scamming customers by making them go through the manufacturer. I have filed a complaint with the Better Business Bureau as this is ILLEGAL! Buyer beware!
