Sold a cell phone to my father in law for $60 when it retails for $15-20. No receipt, no box, no return

My father in law went to this cell phone store to buy a phone because his phone is acting up. On 12/08
Max Huang decided to rip off an older customer by selling a T-Mobile Prepaid NOKIA 1661 cell phone to him for $60.00 (No tax!)
This phone retails for 14.88 at walmart.com and $19.99 at Target Stores.
At the moment of purchase, Max did not provide my father in law a receipt, did not charge tax, I question if they pay tax to the government as well, they also took the original box away and did not give it to my father in law.
2 days later, I went back and confronted Max of his poor practices and wanted a refund for the $60 he ripped us off. Max refused and said its too bad, once the phone is open, you do not have the box, there is no refund.
I told him he cannot rip customers off by selling a $20 phone for $60, he stayed quiet and claims "well, thats how much we sell that phone here".
This store has 2 previous POOR complaints to the Better Business Bureau, i filed a 3rd.
