Item was damaged and case was missing China

I ordered a pair of Sennheiser PX 200 headphones from cell-outlets.com. The picture clearly showed a case and the description mentions the case. When the item arrived there was no case. Also, the headphones were not in very good condition. There was a big scratch on the head bar.

I wrote an email to the site, because there is no phone number listed. Someone replied, and admitted that the picture shows a case, but said that he doesn't supply the case. He said that if it is damaged, I can send it to him and he will replace it. I replied asking if he would pay for the shipping. He never replied to that email and I haven't heard from him since.
