Sell unuseable product, promised refund but won't return call or honor refund

Sam Asgar from Austin Helicopters sold me a Credit Card terminal and promised that if the terminal does not work with my Merchant services or if the terminal is "locked", he will give me a full refund. The terminal end up being "locked" and cannot be used with any other Merchant services other than his. However, he would not return calls or arrange for refund. I also contact Ray Asgar (owner of Austin Helicopters) and he too refuse to return call or honor refund.
