On september 20 I purchased on ebay a New Motorola V195 quad band unlocked GSM Cell phone from Cellz4Less as item #170150457098 for $68.45. The phone arrived and is branded T-Mobile, I went to China purchased a SIM card and tried to use the phone, the SIM card unlocked but the phone brought up a window: Contact Service Provider.

On my return to the US I contacted the vendor and was informed that the 14 days warranty period had expired and my only recourse is to Motorola, various phone calls and emails to Cellz4Less remained without any result or even a response.

I contacted Motorola which, while being sceptic about their possibility to help me, as they estimated that the phone needed the subsidy code, which can only be provided by T-Mobile, requested me to ship the phone, by Fedex, (cost $25,00) to their Memphis service center, the phone came back with the mention that they were unable to find a problem with the phone.

I contacted T-Mobile and was very efficiently and obnoxiously told that as I am not a T-Mobile customer they have no intention in helping me, the fact that the phone was sold by them (Motorola determined that it was not stolen) under false pretences had absolutely no impact on them

I faxed my story to the President's of Motorola and T-Mobile, within a few hours I was contacted by Motorola's corporate customer care, they had me test the phone with a T-Mobile SIM card, it worked, however with any other SIM card the phone requests me to "Contact Service Provider" instead of "Enter Subsidy Password", Motorola therefore estimated that the phone is in working order and cannot be replaced under the Motorola warranty.

From T_Mobile no response whatsoever, in an other phone call I asked for T-Mobile corporate phone number, adress, email or any other possibility to speak to a manager and was refused.

It is clear that T-Mobile sold these new phones to a 3rd party seller and did not unlock them as they should have and that Cellz4Less resold the phones without checking them.

I feel that both Cellz4Less and T-Mobile have sold this phone under a lie.
