Open box scam, we proved it and got our money back Omaha

Electronics and household app.
In February I bought a new Yamaha surround sound reciever.
I was one of the few people on the face of the earth who managed to get one with a bad left channel. It blew two weeks to the day after I bought it.
Best Buys checked it out, confirmed my beliefs, and let me have a new one which I am very happy with.
Now the kicker!!! My nephew found a open box closeout Yamaha receiver marked down from 299.00 to 229.00 at this same Best Buy.
He got it home, and sure as hell the left amp was dead. He took it back and they refused to give him back his money, because it was an open box sale (ie: as is) and accused him of blowing the amp (this same man runs sound boards at rock concerts).
I talked to him in april and he relayed his saga, I tought this is too weird, so we compaired serial numbers. Sure enough, same amp! After a trip to Best Buy and both of us bitching in very loud voices, we got the money back.
