Ripoff... Bad Check claim

This Company wrote a letter to me on March 19 claiming that I had a bounced check from 1998 written to Ames Department Store (which is now out of business as of 2001) on December 5th.

They gave a specific check number, written for the amount of $99.78 and added on a return charge of $30.00... For a total owed of $129.78 They stated in this letter that if I did not pay this debt in thirty days I could be sued.

I called the company and spoke with someone and informed them that I was disputing this debt. They said that I needed to get proof that this check was paid.

I then called my bank and had them research my account for the check number given. (Most banks offer 3 free copies a year to their customers so this did not cost me anything) The bank located this check and mailed a copy to me within a few days. I called JBC back and informed them that I had a copy of my check and according to the bank this check was paid in full upon it's FIRST presentation for payment. Ames NEVER received this check back as bounced... It went thru and was paid the first time they deposited it!

JBC states that I need to mail them my copy as proof. I am NOT going to do that. I know the check was paid and this scam company already has my account number and what bank I go thru... The copy of this check would also give them a copy of my signature and the institutions routing number!!! And I have to wonder, just what problems that might create. And if they do try suing me? So what... I already have proof the debt is invalid.

Whatever you do... If you receive one of these letters DO NOT send them your money... Go right to your bank! Even if you no longer bank where they say this check was written from your former bank should have copies on micro film which they can research for you.

Most places have a set fee for one item researched if you are not a customer. However the fee that the bank may charge you WILL be less than what these scammers are claiming you owe!!
