Ripoff, sold usedone as new New York

I ordered new nikon 300mm telephoto lens for $900 and some other parts for my camera in Jan 9. They sent used lenes so I asked new lens. I got their permission to return the used lens and sent it to the seller. Later, I received another lens but this one also is used one. I paid $1430 for the product and shipping. I also paid at least $350 for customs duties and fees.
I asked them full refund or send brand new lens but they declined both.
The reason they explained was that the first lens that I returned was perfect condition and has no defect. They did not mensioned whether that was new or used.
I did not took photo of the first lens, but I have photos indicating the second lens is used one.
