Puka daycare at carbondale daycare refuses to refund after kicking out my son

I enrolled my son (3 years old) at Puka on 8/11/09 and paid two weeks deposit of $232 $25 registration fee. On 9/10/09 (Thu) at 10:00 am, I was told to pick up my son because my son hit another kids. Then I was told that my son could not come to Puka anymore.

I have already paid Puka for 9/6/07-9/17/07 for $232. The daycare is supposed to pay me back for days from 9/10-9/17 plus two weeks deposit. The total should be $394.4.

I have waited for three weeks but I haven't received any refunds. I called Puka a couple of times for the refunds. The first time, I was told that there needs to be a board meeting to decide whether to refund. The second time, I was told that they sent out a check to a wrong address that I have to wait the check to bounce or I will have to pay for the canceled check fees.

On 10/9/09, I called again and told them that I am going to sue them. They finally gave me $205 for refund. They refuse to refund me the rest. They said that since my son was kicked out, I should be responsible for the rest.
