Took money and did not install carpeting

Mr. Melzer was installing carpeting in a HUD Building and stated he had is own business own the side where he installed carpeting. I spoke with him and he came to my house took measurements of my room and we agreed on the cost of $471.52. I paid him a deposit of $100.00. He agreed that I could pay this over time. The next installment was a money order for $150.00 and the final payment was a check for the amount of $221.52. He came to my house and did not bring the right size carpeting with him. He stated he would have to return when he could purchase the correct agreed upon size of the carpeting. He stated that he had not been working lately and did not have the moeny to purchase it at that time. I have called him upon four occasions since.

He returned my call only once and then left a message that was unclear and stated he had either lost or damaged his phone and to call him at the new number listed on my screen. Unfortunately, there was no new number.

I have tried calling again, left messages but as of this date (4/14/08) have not been able to make contact. I have wrote him a letter which he did not respond to. Unfortunately, I am out the $471,52 and have no new carpeting.
