About 2 years ago I joined MyFico so I could check my credit status thoroughly, clean it up and get ready to purchase a home. Whatever debts were oustanding, I paid them off completely and thought that was the end of it.

A few months later I received a letter in the mail. It wasn't hand delivered. It wasn't certified, it was in an envelope with a stamp on it. I open it up and it's a "notice" to go to court. It was from Stewrat and Associates and they were representing Credigy Receivables.

I knew I did not have a debt that was outstanding (because of my score watch with Fico). I had sued someone in the same county just a few years back and the papers from Stewart and Ass. And the paperwork looked very different. Thinking this was a possible scam, I ignored the papers and threw them away.

Within a year following that letter, I was notified that I now had a default judgment on my name in the amount of $5,845.55

Feeling I had erred, I contacted them and made a "payment plan" with them. I stated making $200 a month payments to them, until I did some investigating and found it could not be my debt for 2 reasons..

1. I found out it was a Discover Card, (which I never had)
2. The "gentleman" (I use that term VERY loosely) from Credigy Receivables told me the last payment that was made on the Discover card was in 2000 and the card was opened in 1999.

The second reason above is what made me stop paying them the $200 a month. That's because I had a severe motorcycle accident in January, was hospitalized for 3 months and left me immobilized for a year and a half.

When I left the hospital, I had no money, no job, no home. I stayed with a freind during my rehabilatation and I doubt if I did (or could have) made a payment to Discover. I had issues with my ex at the time and am pretty sure they opened up the account.

Back to the present. Since the judgment, I have been asking for Credigy to provide proof that these charges were mine. I have sent them certified letters and have never received a reply once. Only the threat of suing me until the year 2026. I know this account is NOT mine and the Credit Agencies are of NO HELP whatsoever.

I have since hired an attorney and they are dilegently working on this for me.
I wanted all of you to know out there what kind of company this is.

Credigy apparently buys old accounts that are on the verge of leaving your credit report. They probably pay pennies on the dollar and then use Stewart and ASS. (both companies are actually one in the same) to bully you to go to court.

If any of you out there recieve a court threat form them, by ALL means. Fight it! Don't make the same mistake I did. Make them show you proof that it's your debt!
