Love Beal & Nixon - CREDIGY - Stewart & Associates Settlement agreement not worth the paper it's printing on?

I won't bore everyone with the painful chain of events that have lead up to this point. Though Stewart & Associates / CREDIGY have really upset me in the past, this latest happening has me really stirred up.

Stewart & Associates / CREDIGY took me to the NAF (National Arbitration Forum). During my allotted time to respond, S & A/CREDIGY was call me, trying to work out a settlement. A week or so before my response was due, I finally broke down and committed to a settlement. They sent me a settlement letter and two days later I overnighted the required down payment via UPS.

I asked S & A / CREDIGY what they were going to do about the NAF case. They stated that as long as I complied with the settlement, that they wouldn't file suit on me, and that all I needed to do was send a copy to the NAF as my response.

So, I did that. About 2 weeks later, I get a letter from the NAF with the verdict. And the winner is: S & A / CREDIGY... Because the settlement letter was not signed by both parties. It also stated that both parties agreed, by signature, to settle this dispute by arbitration. Hmm... I don't remember signing anything.

Back to the settlement agreement

The settlement did contain a small discount off the balance, no interest, and a down payment and 36 monthly payments, starting the following month.

They did receive and deposit the down payment. Then, with online banking, I set up 36 identical payments, using the account number noted on the settlement. My online banking set up the payment as a 1-day EFT. Starting in Oct. I watched each month's payment get sent and confirmed.

Recently, I get a letter and a call from Love, Beal and Nixon, basically stating that they have taken over the account for S & A / CREDIGY due to non-payment, and they wanted to know how I was going to get this cleared up.By the way, the balance they showed wasn't even close. They were missing all of my monthly payments, plus the additional of their fuzzy math that they call interest.

To make a long story short, I have sent (twice) faxes, certified letters to both S & A / CREDIGY and Love, Beal & Nixon, demanding a detailed accounting since the deposit of my down payment, along with all kinds of paperwork. My bank has even faxed proof of payments to both companies.

My first request was never answered; I had to call LBN to get an answer. All they would tell me is "... This is your balance, this is your monthly payment and S & A / CREDIGY said not to file suit against you." Nothing to say about the settlement agreement or the payments.

I did get a letter from LBN from my second request, but it was nothing more than their standard debt validation letter. They did not answer any of my questions.

To date, I have continued to send my monthly payment to LBN. I have not missed any. I have proof of all payments and a detailed phone call log with names and times.

In a nutshell: S & A / CREDIGY doesn't seem to want to recognize my first 5 payments, they've started adding interest, and they've sent me to LBN.

How can I get them to play ball? Should I stop the payments to LBN and start sending payments back to S & A / CREDIGY? Should I send them one last letter stating that I do not agree with the balance nor the interest, and that I will make my 28 remaining payments per the settlement letter, and to feel free to take me to court?

Any help would be great!
