Sent payments but not credited to my account

Saxon purchased my mortgage in november of 07. I sent my mtg payment to my ex mtg holder. They eventually forwarded it to saxon. I paid my dec pymnt on 12/05/07. I paid my jan 08 pymnt on 1/09. Bot paid via atm card. At the end of jan i tried to pay my feb pymnt. Saxon refused it saying i owed over $2k, because i had not paid my Dec or Jan pymnts. Several phone calls later, i was advised by saxon to NOT pay anymore until they got their books straightened out.

I called them almost daily throughout feb. Meanwhile, i secured another loan with another mtg company. Early march i asked saxon for a payoff quote. They sent it but it excluded the pymnts i made in dec and jan (inflating my payoff). I called them and, as usual, they said, "i see where you sent the money but it had not been applied." they promise (over & over & over) to get it fixed and send a valid payoff quote, but they have yet to credit my dec payment, much less my jan payment.

I decided to pay my feb payment via certified mail with a check. They continue to be unable or unwilling to apply my dec and jan payments. Everytime i speak to them they declare, "you are seriously in arrears, what are you going to do to fix this situation?" i re-begin the process and i am promised it will be taken care of in 48 hours... Still NOTHING.

I have invited them to accelerate my loan and begin foreclosure proceedings. I would love to stand before a judge and explain how this company does business. There MUST be laws against this type of practice. I have now lost the time and effort i put into securing my new load which almost halved my interest rate (from 9.375% to 5. Something).

My last conversation with their 'customer service, ' i was informed that my mtg is in 'pre-foreclosure, ' but has not yet been referred to their attorney. I told the csr to PLEASE accelerate that process. (i have all my records printed out showing my payments and next week, when i pay my march pymnt, i will be 100% uptodate) my mail box is being bombarded with solicitations for re-financing with verbiage to this effect: "we understand you are having trouble paying your mtg with saxon, we can help..."
