Emusic commits fraud by billing bank card (s) (THREE) without authorization - from Sept 06 - now! Won't correct!

In September of I began receiving monthly charges of $9.99 for monthly service charges. I did not open this account.

My debit card with BofA was being billed. I began complaining to Emusic and then initiated a Fraud investigationwith my bank, in December of after I saw the month's of charges when that month's caused an overdraft.

In January of a bank Accounts Executive and myself both spoke with EMusic from the bank regarding these unauthorized charges. Emusic confirmed the were billing and that we advised fraudulent. I filed a Fraud Report with Bank, per their request.in the following month, Emusic advised my bank that they found such "proper" and refused to correct, infact kept billing.

In February of with the charges continuing and now refund coming, I cancelled the bank card, again with an Account Executive. He issued a new card with different numbers.

The card came and the following month, the new card was charged against for Emusic monthly fee (s), unauthorized with both a direct Complaint and yet another Fraud Report.

Emusic came back to my bank again and said was valid and they would continue to bill. I kep disputing these charges with my bank. The bank refunded the ODraft charges but would not credit my account on these $9.99 charges.

I have yet further filed 3 more Fraud Reports/Complaints and have now had to close my bank account and open a new account.

Now that EMusic did not have access to any visa cards, they this month, again without my authorization began billing my Discover card, for a service I do not have, have never had, never used, and would NEVER do business with - especially with their reputation which is self-evident on this site alone.

CAVEAT: half way through these processes the Account Exec at my bank was notified that it does not matter whether or not you cancel a card, within the Credit/Banking/Financial systems, all the merchant need do is send a request to bill against any card in that name. This was much to the Reps surprize - as he had been unaware. I AM!!! (now)

Thus, I have complained and cited fraud since late 2006 through and into this month. That to-date (not counting any other charges that came along the way) 17 month's of charges that have not been authorized. And, I DO have the fraud complaints, the bank statements and the documents to prove the 3 different acounts they have "hit". They could care less.

Next stop is my Attorney General's Office and now a police report and litigation in District/Municipal Court.
