I wanted to sell or rent an extra timeshare I own and I called the competing company for advice. There, Dave Walzac on Sat. 4/28, referred me to John Riggins of IBD-Marketing for my request. They both were very helpful at first. John Riggins at first gave me some numbers for selling my timeshare at about $16,000, and said he could get as much as $1,500 for a rental. But I had to advance $598.00 first. When I described this transaction and showed her the contract which did not arrive for over a week (5/12), she said $598 was too much and refuses to sign.
The contract is still not signed. When I called John Riggins back to request a refund, he demanded to speak to my wife, but she was not home at that time. He said that I should have her call him for his reasons this is a good deal. Then he suggested why don't I just sign it myself without her approval and send the contract back. No I did not.
This is where I am. Does he and IBD-Marketing have the right not to refund the charge on my credit card? He keeps referring to that he has a taped recording of my original call, but my wife was not included in that call. I feel that there is no signed contract, and even my call which did not include my wife does not validate any claim IBD-Marketing has. The payment should not be demanded until the contract is signed and returned.
