Failed to deliver my photos, and never returned my film. Rip-off!

Over the past 2- years, I have used York Photo Labs for most of my film developing, as they used to be prompt and reliable. Normally I would receive my pictures within 7-9 calendar days from the day I mailed the order. However, at this point, it appears that York Photo has lost me as a customer.

York Photo has failed to return a processed photo order from a roll of (APS) film which I had sent to them on 9/24/04. The check which I had enclosed to them of $9.25 cleared my bank account on 10/01/04. York Photo also failed to return my film.

After 2 weeks, I became concerned, and began to write to them. On or about 10/18/04, I filled out, and sent them, a Tracer Form which I happened to have. I made copies of the form, and have written to them several times. To date, I've only heard from them twice 2 letters in which they apologized and asked me to fill out a tracer form. The second request came after I had already sent them at least 2 copies of the form!!! At this point, I now realize that they probably lost my film, and perhaps their requests are merely stall tactics, and that they are doing nothing to resolve this matter.

On or about 11/20/04, I sent York Photo a final notice, in which I demanded immediate shipment of my photos and film, or if (as I suspect) they lost my film, that they send me a refund plus compensation for the cost of my roll of film. I also advised them that if they failed to respond to my notice, I would begin to take other legal steps in about 2 weeks (i.E., filing complaints with appropriate consumer agencies).

Needless to say, York Photo has not responded to my final notice. It's obvious that I am extremely annoyed with York's handling of this matter. Therefore, I am now making my complaint known.
