Ripoff Merchant Agents and Company "evasive" in processing refund for unexecutable contract Baltimore

Responded to company ad for Patio addition to property. Sales Agent drafted contract for project on May 5 after price negotiation. Proceeded to request deposit downpayment of (7$, 000.00) or one-third of total project cost.

Upon careful inspection of contract, found questionable clause suggesting down payment non-refundable; insisted that sales agent ammend the contract to stipulate "contigent upon financing approval" for the questionable clause.

Almost 60 days after my check was cashed from an interest bearing account, Sales Agent and Sales Agent Manager are suddenly [evasive] in responding to request for refund due to inability to fund balance of project.

It appears the plan is to hold out long enough to allow a favorable mortgage refinance deal to fund the project. I have repeatedly advised Sales Agent that because I am locked in for 2 years due to recent refinance the prospects for another refinance is bleak, especially given the high closing costs for such transactions in Maryland. It will effectively tack on fees of between $4,000 to $7,000 dollars to the loan amount needed depending on how the lender chooses to structure the deal.

This Sales Agent is habitually telling me he is trying to help me in spite of extenuating credit conditions, even after I have indicated to him that all I want is my refund in Bank/Cashier's check. I have (zero confidence) in Custom Patio Rooms of Philadelphia/Baltimore organization and it's representation of doing good/quality work. It has been a "catch-can-can" ordeal.
