Misleading! Damaged item sold as new - exhorbitant shipping Chicago Illinois

On December 29, I was on E-bay and won a bid on a Popeil Pasta Maker from the above seller. This machine was advertised as "brand new in box retail value 269.98" and listed all its features. There was a picture of "the" supposed pasta maker and all of its amenities sitting in front of its box.

Because I believed the seller's shipping charge to be an extremely high estimate ($22.00) I sent him a message asking him to readjust (I had contacted UPS and they had told me it would be $13.75). The seller returned my message saying "Send me total amount". So on 1 Jan I used PayPal to purchase the machine.

On January 10, I received the pasta maker and its condition shocked me. The box was mangled and there was tape holding it somewhat together. The styrofoam container inside the box, which held all the components, was mashed and misshapen and had GRASS on it!!! The measuring cup was smashed, and all of the sausage components were missing. The recipe book was water damaged and pages were missing. The 12 dies, it turns out, were ones the seller had just thrown in the box, and some of them were duplicates.

I believed at first that the shipper had damaged the shipment, but further investigation showed that the seller had purchased the item from a Penneys Catalog warehouse as a damaged item. I could tell because there were Penneys "as is" stickers all over the box.

I contacted E-bay and opened a Squaqre Trade case, but as you probably already know, their processes all have no teeth unless you pay them exhorbitant fees to "talk" to the seller. So I am pleased to have this recourse to tell of my frustration with this seller. He misrepresented this item and ripped me off. What makes me even madder is that he gave me a bad report on my E-bay account, saying I "couldn't read"! Buyers beware of this guy, he is only on E-bay to rip you off!
