Inc 13 months, work still not complete

I signed a contract with BT Spence on 5/28/08 for over $11k in work to my home. Matt was very attentive until the contract was signed. Then there were multiple issues that delayed the start of the work. There was always some excuse why the work at my home is not a priority.

When a roof finally was put on it was not the roof I ordered. Matt initially brushed off my complaint until he realized they had indeed put the wrong roof on my house.

First he suggested *I* pay the cost difference for the correct roof—the one on my contract. When I advised that surely he was not suggesting that I pay for their mistake he offered a nominal discount on the remaining work. I declined. I ordered a 40 year shingle in a different color. I got a 30 year shingle in the wrong color.

All work stopped as they were to work top to bottom. Matt left a few messages telling me they were coming. Then messages with excuses why they were not coming. Nothing has been done since the wrong roof was put on my home.

I thought perhaps the spring would bring them out. Nothing.

I called Matt on May 22 and left a message stating I wanted the work completed in the next 30 days. He left me a message on May 26 stating they would be out "late next week as weather permits." There have been good weather days this week. Enough to do all the work. No Matt. No call. Nothing.

Matt accepted a $10k check from me and hasn't done the work. It looks like I'm going to have to sue for breach of contract. Save yourself a headache and don't hire BT Spence.
