Deceptive Trade Practice

On Thursday April 16th, my wife and I went to Discount Mattress and Furniture store in Sinton Texas. They were having a "going out of business" sale, when in reality they were moving to Rockport. We were interested in a king size mattress set, the salesman/owner showed us a mattress set that he claimed sold at other stores in the area, for $4200.00. It is supposedly, a visco memory foam bed with pocketed coils that he said was comparable to a Stearns & Foster in construction and quality. I asked who the mattress was maid by, and he said it was by Corsican Bedding and they were a top of the line manufacturer that actually made mattresses for other top mattress companies. We were told that since they were closing that he would sell us the set for only $1000.00 plus tax and delivery charge, but only if we bought it that day. Unfortunately we fell for his deceptive trade practice.

The mattress we received feels NOTHING like the one we tested in the showroom, after sleeping on this thing for one night, we could hardly get out of the huge indention in the middle of the bed, so we put it back in its pagkaging and placed it in our garage. The next morning I contacted this guy and he said he would make good on the bed and replace it since it must be defective. It has now been 10 days and he won't return my calls or respond to emails. After doing some research, we have found that his claims about Corsican Bedding Inc. Be a "top of the line" manufacturer is far from the truth! In fact they have an F rating with the Better Business Bureau and the problems that we are having is a common problem with this manufacturers beds according to Epinions.com. Nothing but complaints.

I just went through a tough battle with cancer and survived a year without income and can't afford to be throwing away $1136.62 on a mattress that I can't use. I am pretty sure that his tactics and claims are a violation of the Texas Deceptive Trade Practices Act, and hate to think that this guy is deceiving and ripping off the general public.
