I moved into a Brewer Calwell home in December as kind of a last minute thing. I was trying to purchase a home right before the birth of my 3rd child and it fell through. I had just days to find a place to live. Had I done my homework, I would have never selected a home managed by this company.

The relationship with Brewer Caldwell has been rocky from the start. The home was turned over to me in poor condition and it took forever for them to rectify anything. I actually had to send them a letter via fax and mail to get the issues resolved and they were still taken care of so poorly that most of the repairs need to be made again.

Anyhow, last month I called in and paid my rent on the 5th. I was told I had to pay $100 for late fees and $50 for the service of a 5-day notice. I paid the full balance. On the 6th, I was served a 5-day notice and the notice was dated the 6th. I am in property management as well. I reviewed my lease, called in and spoke to one of the girls at the attorney we use here where I work, and realized I shouldn't have been charged for the service for a 5-day if I paid my rent before it was ever dated and served. I contacted the property manager, Hunter Stuart, several times via phone and e mail. I finally got a response from him late in the month that he would try but no promises. I e mailed him again on September 26th and asked if it had been resolved yet. He did not call or e mail back.

Now, on October 3rd, which is still within my grace period, I called to make my rental payment over the phone. They had me owing the full balance and would not accept anything less. I called Hunter several times throughout the afternoon as well as his boss Ryan and left messages that were never returned. I didn't want to be charged more late fees so I called the accounting department again to try and just pay the entire balance but they didn't answer and I left them several messages as well. I never received a return phone call.

I called this morning again and was finally transferred to Hunter Stuart. I went over the situation again with him and asked if we could get it resolved. He said that he did believe I was owed a credit but then stated you do realize you owe late fees again today. I told him no, that I would not be paying any late fees, I had plenty of documentation that I had been trying to resolve this matter with him over the last month and I left several messages with the accounting department on Friday. He laughed, said is that so, and then said I will talk to you later and hung up on me. I called the accounting department back and paid the full balance. I just want the $50 credited to my account, that even he admitted is owed to me.

I feel like I have gone overboard trying to solve this problem with them amicably and I am butting my head against a brick wall. Any advice would be very appreciated. This is over fifty rediculous dollars but it is the principal of the matter!
