Consumer Home Repair Fraud

Purchased a brand new 2008 Energy efficient Dutch modular home, foundation FHA compliant including tiled inside and outside and sump pump and sealed, termite & vermon proof, 2nd set tiles for gutters - entered into verbal agreement in June 07. $25,900 down July 07, paid $90,577 at closing l 01/18/08 w/promise they would complete the work w/in 48 hours of closing. They failed to honor our agreement.

Crawl space has been submerged in over 2' of standing water for months, they failed seal coat the foundation, install the exterior drain tile & sump pump, improperly installed interior drain tiles twice, didn't tile the gutters - failed to use proper tie downs, no rebarb in foundation walls, no foam seal plate on top of foundation, no termite shield around foundation, no insulation in floor/ceiling of crawl to protect pipes (when winds blow thru crawl space - flooring in kitchen area blows up from floor and can feel blowing thru carpet thru-out home), heat/ac does not properly flow thru home.

Ceiling/Interior walls bowed, ceramic tile thru has pulled away from seals, lights turn on and off because they are overheating. Failed to install (2) patio's, interior/exterior doors are improperly fitted, etc... I'm out thousands of dollars before project was closed due to them failing to meet 45 day installation and multiple deadlines for closing, lost one loan and interest rate jumped, not including currently have to put money out to correct water problem due to their failure to complete the project.

I've used 3 tanks of propane to heat this home due to improper insulation/fittings. Spradlin had to raise home and install another (2) rows of block due to their failure to shoot the grade properly - damaging the home interior exterior.

List supplied in Dec. 2007 and Feb & September. Spradlins - Jess Spradlin is totally aware of all these issues and yet refuses to address them and in fact has threatened prior to final closing to have the home removed and put mechanics liens against my land.

June 08 contact was made with the Dutch Factory and was advised Spradlin's is totally responsible to resolve all issues with the buyer and if there is a factory problem Spradlins was responsible to contact them. They contacted the Springfield store and was advised my issues were valid. They requested I allow another 60 days for Spradlin to address issues and complete work.

On or about August 27th a complaint was filed with the Peoria IL Better Business Bureau under complaint #19012690.

On September 8th a certified letter to demand for the performance and completion of the home construction was issued to Spradlins under the Illinois Home Repair Fraud Act 815ILCS515/3.

To date the home issues have not been resolved whatso ever.
